If You (User) visit www.videocomments.co.uk You (User) agree to these terms of service and to our Privacy Policy, located HERE. If You (User) do not agree to either of these policies, do not continue to visit these sites. As used in this agreement, “Video Comments Limited” refers to www.videocomments.co.uk. Video Comments Limited is located The Bristol Office, 2nd Floor 5 High Street, Westbury on Trym, Bristol, England, BS9 3BY.
Content and Copyright Notice
All content on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Video Comments or its content suppliers and protected by United Kingdom and international copyright laws. The compilation of all content on this site is the exclusive property of Video Comments Limited and protected by United Kingdom and international copyright laws.
Our Services
Using our Video Platform and App (Video Comments), gives users the opportunity to upload/watch/share videos and video comments, our platforms provides users the platform to connect with others users worldwide. Video Comments Limited also provides a personalised/business subscription service that allows our members to access Video and Video Comments. Our content is streamed over the Internet to devices, internet-connected TVs and computers.
Registration
You (User) may create an account to use certain features we offer (e.g., creating or uploading Videos Comments). To do so, You (User) must provide an email address. By creating an account, You (User) agree to receive notices from Video Comments at this email address.
Subscription Plans
We offer paid subscription plans that allow You (User) to create and share Video Comments content. We may also offer additional digital content or services on a pay-per-use basis. Advertised prices and features may change. Each plan is valid for only one single end or business user. If You (User) have registered on behalf of a company or organisation, each end user must register for his or her own account.
You (User) must pay all fees (plus any taxes) during Your (User) subscription period and any renewal periods. Our fees may include a fixed monthly or annual fee plus variable fees for transactions or usage. All fees are nonrefundable.
Subscriptions automatically renew at the end of each subscription period unless cancelled before. Monthly plans renew for 30-day periods, Annual plans renew for one, two or three year periods. You (User) must pay the annual or monthly fee (plus any taxes) when each renewal period starts.
Subscribers may opt out of automatic renewal by cancelling in payment section via account settings. Any opt-out or notice of non-renewal will not affect the current subscription period. You (User) may not sell, resell, rent, lease, or distribute any subscriptions plan or any other aspect of our services to any third party.
Payments.
To use the Video Comments service You (User) must provide one or more Payment Methods. You (User) authorise us to charge any payment method associated to Your (User) account in case Your (User) primary payment method is declined or no longer available to us for payment of Your (User) subscription fee. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and You (User) do not cancel Your (User) account, we may suspend Your (User) access to the service until we have successfully charged a valid payment method, You (User) remain responsible for account balance and uncollected amounts. Some Payment Methods Your (User) issuer may charge You (User) certain fees, such as foreign transaction fees or other fees relating to the processing of Your (User) Payment Method. Local tax charges may vary depending on the Payment Method used. Check with Your (User) Payment Method service provider for details. You (User) can update Your (User) Payment Methods by going to the “Profile” page. We may also update Your (User) Payment Methods using information provided by the payment service providers. Following any update, You (User) authorise us to continue to charge the applicable payment method(s).
Copyright Complaints
Video Comments and its affiliates respect the intellectual property of others. If You (User) believe that Your (User) work has been copied in a way that constitutes copyright infringement, please go to our contact page and request removal of the infringing content.
Permission of use, Age Requirements and by Parent or Guardian
You (User) must be at least 16 years old, or the applicable age of majority in Your (User) jurisdiction, whichever is greater, to create an account or otherwise use our Services. If You (User) wish to create an account for a commercial purpose, You (User) must be at least 18 years old. Individuals under the applicable age may use our Services only through a parent or legal guardian’s account and with their involvement. Please have that person read this Agreement with You (User) and consent to it before proceeding. If You (User) are a parent or legal guardian of a user under the age of 16, by allowing Your (User) child to use the Service, You (User) are subject to the terms of this Agreement and responsible for Your (User) child’s activity on the Service.
Business
Please ensure if You (User) are using the service on behalf of a business, You (User) confirm to us that You (User) have authority to act on behalf of that entity, and that entity accepts this Agreement.
You (User)r Information
Our Privacy Policy explains how we treat Your (User) personal data and protect Your (User) privacy when You (User) use the Service. We will process any audio or audiovisual content uploaded by You (User) to the Service in accordance with our terms.
Permissions and Restrictions
You (User) may access and use the Service as made available to You (User), as long as You (User) comply with this agreement and the law.
You (User) are not allowed to:
access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify or otherwise use any part of the Service or any Content except: (a) as specifically permitted by the Service; (b) without prior written permission from Video Comments and, if applicable, the respective rights holders; or (c) as permitted by applicable law;
collect or use any information that might identify a person (for example, harvesting usernames or faces), unless permitted by that person or allowed under section 3 above;
use the Service to distribute unsolicited promotional or commercial content or other unwanted or mass solicitations (spam);
Content Restrictions
The following restrictions apply to You (User)r use Video Comments Service.
You (User) are not allowed to submit any content that:
Is defamatory;
Infringes any third party’s copyrights or other rights (e.g., privacy rights, trademark, etc.);
Violates any applicable law.
Is sexually explicit or proposes a sexual service;
Exploits or endangers minors;
Is harassing or abusive;
Depicts or encourages self-harm or suicide;
Contains hateful or discriminatory speech;
Promotes or supports terror or hate groups;
Instructions to assemble homemade/improvised firearms/explosive/incendiary devices;
Depicts unlawful real-world acts of extreme violence, or (2) animal cruelty or extreme violence towards animals;
Promotes deceptive marketing practices, fraudulent or dubious money-making schemes, proposes an unlawful transaction;
Contains conspiracy-related content where the underlying conspiracy theory makes claims that suggest that a real-world tragedy did not occur, violate other content restrictions;
Contains false information or misleading claims about COVID 19, vaccination safety; health-related information that has a serious potential to cause public harm;
Misuse any reporting, flagging, complaint, dispute, or appeals process, including by making groundless, vexatious, or frivolous submissions;
Cause or encourage any inaccurate measurements of genuine user engagement with the Service, including by paying people or providing them with incentives to increase a video’s comments.
Changes to the Service
Video Comments is constantly changing and improving the Service. We may also need to alter or discontinue the Service, or any part of it, in order to make performance or security improvements, change functionality and features, make changes to comply with law, or prevent illegal activities on or abuse of our systems. Whenever reasonably possible, we will provide notice when we discontinue or make changes, however there will be times when we need to make such changes without notice.
Your (User) Content and Conduct
If You (User) choose to upload Content, You (User) must not submit to the service any content that does not comply with this Agreement or the law. For example, the content You (User) submit must not include third-party intellectual property (such as copyrighted material) unless You (User) have permission from that party or are otherwise legally entitled to do so. You (User) are legally responsible for the Content You (User) submit to the Service. We may use automated systems that analyse You (User)’re content to help detect infringement and abuse, such as spam, malware, and illegal content.
Conduct
The following restrictions apply to Your (User) use of Video Comments Service.
You (User) are not allowed to submit any content that:
Use an explicit language or offensive avatar;
Access another’s account without permission;
Engage in any unlawful activity;
Collect personal information about others;
Harm or exploit minors;
Act in a deceptive manner or impersonate any person or organisation;
Distribute “spam” in any form or use misleading metadata;
License Grant by You (User) and Duration of Licence
By providing Content to the Service, You (User) grant worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to use that Content (including to reproduce, distribute, modify, display and perform it) for the purpose of operating, promoting, and improving the Service. You (User) own and will retain ownership of all intellectual property rights in and to the content You (User) submit for the purpose of creating or editing a video. By submitting such content, You (User) grant Video Comments permission to use, copy, distribute, sublicense, transmit, make derivative works from, and publicly perform and display through all means such works for the purpose of: (a) analysing Your (User) content using automated technologies for the purpose of creating videos; (b) creating videos using Your (User) content, in conjunction with other content that we may supply (including Third-Party Content, defined below); and (c) streaming and distributing those videos to end users of You (User)r choosing.
You (User) also grant each other user of the Service a worldwide, non-exclusive, royalty-free licence to access Your (User) Content through the Service, and to use that Content (including to reproduce, distribute, modify, display, and perform it) only as enabled by a feature of the Service. The licences granted by You (User) continue until the Content is removed as described below. Once removed, the licences will terminate, except where the operation of the Service, use of Content permitted before Your (User) removal, or the law requires otherwise. For example, removal of Content by You (User) does not require Video Comments to: (a) recall Content that is being used by other users within any limited offline viewing functionality of the Service; or (b) delete copies we reasonably need to keep for legal purposes.
Removing Content and Removal of Content
You (User) may remove Your (User) Content from the Service at any time. You (User) must remove Your (User) Content if You (User) no longer have the rights required by these terms. If we reasonably believe that any Content is in breach of this agreement or may cause harm to Video Comments, our users, or third parties, we shall remove or take down some or all of such Content. We will notify You (User) with the reason for our action unless we reasonably believe that to do so: (a) would violate the law or the direction of a legal enforcement authority, or would otherwise risk legal liability for Video Comments, Partners or Affiliates
Copyright Protection
If You (User) believe Your (User) copyright has been infringed on the service, it is paramount to notify us using the Contact Us page. We respond to all notices of alleged copyright infringement according to the international law of Copyrights. Video Comments policies provide for the termination, in appropriate circumstances, of repeat Copyright infringers’ access to the Service.
